1)\u00a0INTRODUCTION\u00a0–\u00a0THE NOTION OF TOURIST PACKAGE<\/strong><\/p>\n

\n
Given that:<\/div>\n

a)\u00a0Legislative Decree\u00a0No.\u00a0111 of\u00a017.3.95, implementation\u00a0of\u00a0Directive 90\/314\/EC, provides\u00a0for the protection\u00a0of the consumer that the organizer and the seller of the package,\u00a0to whom the consumer turn, must be in possession of the administrative authorization to carry out their\u00a0activities\u00a0(Article\u00a03 \/ 1 letter a Legislative Decree\u00a0111\/95).<\/p>\n

b)\u00a0the consumer is entitled\u00a0to receive a copy\u00a0of the sale contract\u00a0for the tourist package\u00a0(under Article\u00a06 of Legislative Decree\u00a0111\/95),\u00a0which is essential document for any access\u00a0to the Guarantee Fund\u00a0referred to in Article\u00a018 of these\u00a0general Terms and Conditions.<\/p>\n

 <\/p>\n

The notion of\u00a0 ‘tourist package’\u00a0(Article 2\u00a0\/ 1 Legislative\u00a0Decree\u00a0111\/95)\u00a0is as follows:<\/div>\n

The\u00a0packages refer to\u00a0travel,\u00a0holidays and\u00a0“all inclusive” circuits,\u00a0resulting from the prearranged combination\u00a0of at least\u00a0two of the items\u00a0listed below,\u00a0sold\u00a0or offered\u00a0for sale\u00a0at a flat rate price,\u00a0and lasting more than 24\u00a0hours or\u00a0extending over a period\u00a0of time including\u00a0at least one night:<\/p>\n

a) transport;<\/p>\n

b) accommodation;<\/p>\n

c) tourist services\u00a0not ancillary\u00a0to transport or accommodation\u00a0(omitted)\u00a0… that\u00a0constitute a significant part\u00a0of the\u00a0“tourist package”.<\/p>\n

 <\/p>\n<\/div>\n

\u00a02)\u00a0LEGISLATIVE SOURCES<\/strong>
\nThe contract\u00a0for the sale of\u00a0the package,\u00a0is regulated not only\u00a0by these general conditions,but also\u00a0 by the terms\u00a0indicated\u00a0in the travel documents delivered to the consumer.\u00a0 This contract,\u00a0whose object may include\u00a0 to provide services\u00a0in the\u00a0country and\/or abroad,\u00a0will also be regulated by the provisions\u00a0–\u00a0as applicable – of Law\u00a0No.\u00a01084 of\u00a027\/12\/1977\u00a0ratifying and implementing the\u00a0International Convention on Travel Contracts\u00a0(CCV)\u00a0signed\u00a0in Brussels\u00a0on 23.4.1970\u00a0and by the\u00a0above-mentioned Legislative Decree\u00a0111\/95.<\/p>\n

 <\/p>\n

3) MANDATORY INFORMATION\u00a0REQUIRED\u00a0– TECHNICAL DATA SHEET<\/strong>
\nThe organizer\u00a0has\u00a0the obligation to implement in the catalog, or\u00a0 in the program not included in the catalog, \u00a0 a technical data sheet.\u00a0The elements\u00a0required\u00a0to be included\u00a0in the technical sheet of the catalog, or of the program out\u00a0of the catalog, are:
\na) references to\u00a0the administrative authorization of the organizer;
\nb) references to the\u00a0civil liability\u00a0insurance policy;
\nc) the period\u00a0of validity\u00a0of the catalog\u00a0or out-of catalog program;
\nd)\u00a0 reference\u00a0exchange rate for the purposes\u00a0of currency adjustments: day\u00a0or value;<\/p>\n

\n
4)\u00a0RESERVATIONS<\/strong><\/div>\n

The reservation request\u00a0must be\u00a0made \u200b\u200bon the appropriate contractual form, in the case of electronic settings, fully completed\u00a0and signed by the\u00a0customer,who will receive a\u00a0copy.\u00a0The\u00a0acceptance of a reservation\u00a0is\u00a0considered complete,\u00a0resulting in\u00a0the conclusion\u00a0of the contract, only\u00a0when\u00a0the organizer\u00a0sends specific confirmation,\u00a0including possibly\u00a0 by electronic means, to the client\u00a0at the\u00a0 selling travel agency.<\/p>\n

Details of the tourist package not\u00a0contained in the contract documents,\u00a0brochures or\u00a0other means of\u00a0written communication, will be provided\u00a0by the organizer in\u00a0 timely manner before the\u00a0trip, in\u00a0fulfillment\u00a0of the organizer’s established obligations as from the Legislative Decree\u00a0111\/95 .<\/p>\n<\/div>\n

5) PAYMENT<\/strong>
\nThe registration fee, or\u00a0the individual cost of booking,\u00a0to cover the administrative rights, is established to be \u20ac\u00a025.00.
\nThe\u00a0extent\u00a0of the advance,\u00a0which is established to be 25%\u00a0of the\u00a0price of the tourist package, plus\u00a0the registration fee\u00a0and possibly any insurance fee, is\u00a0payable\u00a0on booking\u00a0or on commitment to purchase.\u00a0Within 15\u00a0calendar days\u00a0before departure, the balance\u00a0must be paid.\u00a0Failure to pay\u00a0the above amounts by the dates set out\u00a0above,\u00a0 constitutes express decisive clause, such to determine, by the intermediary agency\u00a0and \/\u00a0or the organizer, the cancellation of the contract.<\/p>\n

6)\u00a0PRICE<\/strong><\/div>\n

 <\/p>\n

The price\u00a0of the tourist package is\u00a0determined in the contract,\u00a0with reference\u00a0to what is stated\u00a0in the catalog or in the program out of catalog and to any updates of these\u00a0 catalogs or out-of-catalog programs subsequently added .\u00a0 It\u00a0can be changed up to 20 days\u00a0before departure and\u00a0only in consequence of\u00a0changes in:<\/div>\n

 <\/p>\n

– transportation costs, including the cost\u00a0of fuel;<\/div>\n

 <\/p>\n

– dues and taxes on certain types\u00a0of tourist services\u00a0such as levies, landing fees, disembarking or\u00a0embarking fees at ports\u00a0and airports;<\/div>\n

 <\/p>\n

– the exchange rates\u00a0applied to the package in question.<\/div>\n

 <\/p>\n

For these\u00a0changes\u00a0we will refer to\u00a0the exchange rates and\u00a0the above costs that are in force at the\u00a0date of\u00a0publication of the program as therein\u00a0stated\u00a0in the catalog\u00a0or on the date shown\u00a0in the\u00a0\u00a0above possible updates.<\/div>\n

 <\/p>\n

Fluctuations will affect the\u00a0global prices\u00a0of the tourist package\u00a0in the percentage expressly indicated\u00a0in the catalog or the out-of-catalog program.<\/div>\n

 <\/p>\n

7)\u00a0CANCELLATION BY THE CONSUMER<\/strong><\/div>\n

 <\/p>\n

7.1)\u00a0Cancellation\u00a0without penalty.<\/span><\/em><\/div>\n

 <\/p>\n

The consumer\u00a0may cancel the contract\u00a0without paying penalties\u00a0in the following cases:<\/div>\n

a) increasing the\u00a0price referred\u00a0to in\u00a0Article\u00a06 above, in excess\u00a0of 10%;<\/p>\n

b)\u00a0significant modification\u00a0of one or\u00a0more elements\u00a0of the contract that can be objectively construed\u00a0 as fundamental for the fruition of the tourist package\u00a0as a whole\u00a0and proposed\u00a0by the organizer after\u00a0the conclusion\u00a0of the contract itself\u00a0 but\u00a0before departure and not accepted\u00a0by the consumer.<\/p>\n

In the cases mentioned\u00a0above, the consumer has\u00a0the right\u00a0either:<\/p>\n

a) to\u00a0take advantage of\u00a0an alternative tourist package\u00a0at no extra\u00a0charge or with\u00a0the restitution of the price difference,\u00a0if the\u00a0second package has a value\u00a0lower than the first;<\/p>\n

b) or to the\u00a0refund of\u00a0the\u00a0price\u00a0already paid.\u00a0Refund must be\u00a0made \u200b\u200bwithin seven\u00a0working days following receipt\u00a0of the request\u00a0for reimbursement.<\/div>\n

The consumer\u00a0must communicate\u00a0his decision (to\u00a0accept the change\u00a0or\u00a0 to cancel)\u00a0no later than two working days\u00a0from the moment\u00a0he received the notice\u00a0of increase or\u00a0change.\u00a0In the absence\u00a0of express\u00a0notice within\u00a0such period,\u00a0the proposal made\u00a0by the organizer\u00a0is considered accepted.<\/p>\n

7.2) Cancellation with penalties.
\n<\/em><\/span><\/div>\n

 <\/p>\n<\/div>\n<\/div>\n<\/div>\n

The consumer\u00a0who withdraws from the\u00a0contract prior to\u00a0departure outside\u00a0of the conditions listed\u00a0in the first paragraph, will be charged\u00a0–\u00a0regardless of the payment of the account\u00a0– in addition\u00a0to the registration fee\u00a0and any\u00a0insurance premium,\u00a0the following\u00a0penalties:<\/div>\n<\/div>\n
\n
    \n
  • up to 30\u00a0calendar days\u00a0prior to departure: no penalty;<\/li>\n
  • 29 to\u00a015 calendar days\u00a0prior to departure:\u00a025%\u00a0of the attendance fee;<\/li>\n
  • from 14 to 8\u00a0calendar days\u00a0prior to departure: 50%\u00a0of the attendance fee;<\/li>\n
  • within 7\u00a0calendar days\u00a0prior to departure: 75%\u00a0of the\u00a0 attendance fee.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n
    No\u00a0refund will be given\u00a0to the customer\u00a0in the following\u00a0cases:<\/div>\n
    \n
      \n
    • no-show, that is,\u00a0 not being present on the day\u00a0of arrival\u00a0without giving\u00a0prior written notice\u00a0to the organizer,<\/li>\n
    • interruption of travel\u00a0or residence,<\/li>\n
    • impossibility to\u00a0make the trip\u00a0due to lack or\u00a0irregularity of foreign travel documents or any other fulfillment necessary to carry out the trip.<\/li>\n<\/ul>\n<\/div>\n
      The withdrawal from bookings that involve \u00a0reservations of airline, ship\u00a0 or train transportation, are subject insofar as transportation,\u00a0to the penalties\u00a0provided\u00a0by the individual carrier.<\/div>\n
      In the case of\u00a0pre-formed groups, such fees will be agreed upon from time to time at the moment of\u00a0 undersigning the contract.<\/div>\n<\/form>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n

       <\/p>\n

      8) MODIFICATION\u00a0OR CANCELLATION\u00a0OF THE TOUR PACKAGE\u00a0BEFORE DEPARTURE<\/strong><\/p>\n

      \n

       <\/p>\n

      8.1) Modifications required\u00a0by the customer<\/em><\/div>\n

       <\/p>\n

      The changes requested\u00a0by the customer\u00a0prior to departure,\u00a0after the\u00a0booking is confirmed,\u00a0do not bind\u00a0the organizer in cases where such modifications can not be satisfied.<\/div>\n

       <\/p>\n

      In any\u00a0case, the\u00a0requests for\u00a0changes related to the reservation owner,\u00a0hotel\u00a0accommodation and treatment will result for\u00a0the consumer, in the\u00a0fixed charge\u00a0of \u20ac\u00a025.00,\u00a0non-refundable in case of\u00a0 cancellation.<\/div>\n

       <\/p>\n

      Modifications related\u00a0to:\u00a0change of\u00a0hotel complex, departure date,\u00a0reduction in the number of participants, length of stay\u00a0will\u00a0be considered cancellation by the consumer and\u00a0therefore will follow\u00a0the requirements of Article\u00a07.<\/div>\n

       <\/p>\n

      8.2)\u00a0Cancellation of the\u00a0tour package<\/em><\/div>\n<\/div>\n

       <\/p>\n

      \n

      \n
      \n
      \n
      \n
      In the supposition that,\u00a0before departure,\u00a0the organizer communicates in writing the inability to provide one\u00a0or more of the\u00a0services covered by the tour package, proposing\u00a0an alternative solution\u00a0the consumer\u00a0may exercise\u00a0the right to\u00a0either regain\u00a0the amount already\u00a0paid, or accept the offer\u00a0of a\u00a0proposed replacement package (under\u00a02\u00a0nd<\/sup> and 3 rd<\/sup>\u00a0paragraph of the above Article 7).<\/div>\n

       <\/p>\n

      The consumer may\u00a0exercise the\u00a0rights mentioned above, even when\u00a0the\u00a0cancellation depends on the\u00a0failure to reach the\u00a0minimum number\u00a0of participants anticipated \u00a0in the catalog or in the program outside the catalog.<\/div>\n

       <\/p>\n

      The\u00a0organizer who cancels the tour package, pursuant to article\u00a01469 bis No. 5 of\u00a0Civil\u00a0Code , will return to the customer\u00a0 twice\u00a0the amount actually paid by the customer\u00a0and materially collected\u00a0by the organizer, except in the following\u00a0cases:<\/div>\n

       <\/p>\n<\/div>\n

      a) cancellation due to one of the cases provided for in Articles.\u00a012 and 13 of\u00a0Legislative\u00a0Decree 111\/95,\u00a0or\u00a0force majeure,\u00a0unforeseeable circumstances and\u00a0failure to reach the\u00a0minimum number\u00a0of participants.<\/div>\n

       <\/p>\n<\/div>\n

      b)\u00a0lack of acceptance\u00a0by consumers\u00a0of the possible\u00a0alternatives offered\u00a0by the organization\u00a0in accordance with Article\u00a013,paragraph 1 of\u00a0Legislative\u00a0Decree\u00a011\/95.<\/div>\n

      The\u00a0refunded sum\u00a0will not exceed\u00a0double the amount\u00a0that the consumer\u00a0would be\u00a0liable\u00a0on that date\u00a0in accordance with\u00a0Article 7.2\u00a0above, if\u00a0he\u00a0had\u00a0to\u00a0cancel.<\/p>\n

       <\/p>\n

      9)\u00a0CHANGES\u00a0AFTER DEPARTURE<\/strong><\/p>\n

      The organizer, should after\u00a0the departure be unable to\u00a0provide for any reason,\u00a0except\u00a0for a circumstance due to the consumer,\u00a0an essential part\u00a0of the\u00a0services included in the\u00a0contract, must prearrange alternative solutions,\u00a0without additional\u00a0cost to the contractor, and in case the\u00a0services offered are of\u00a0lower value than\u00a0those provided for, reimburse\u00a0an amount equal\u00a0to the difference.<\/p>\n

      In the evenience\u00a0 no alternative solution proves possible,\u00a0or the solution offered\u00a0by the organizer\u00a0is refused by the\u00a0consumer for serious\u00a0and justified reasons,\u00a0the organizer will provide\u00a0at no extra cost,\u00a0a vehicle\u00a0equivalent to the original means of transportation as was arranged to\u00a0return\u00a0to the starting point\u00a0or to any other place\u00a0agreed upon, consistent\u00a0with the availability of vehicle and seats, and will refund\u00a0to the extent\u00a0of the difference\u00a0between the cost\u00a0of services provided and\u00a0the services performed up to the time\u00a0of anticipated return.<\/p>\n

      \u00a010)\u00a0REPLACEMENTS<\/strong><\/p>\n

      The renunciating customer may be\u00a0substituted by another person provided that:<\/p>\n

      a) the\u00a0organizer is informed\u00a0in writing\u00a0at least 4 days\u00a0before the\u00a0date fixed\u00a0for the departure, contextually receiving information regarding\u00a0the identity\u00a0of the assignee;<\/p>\n

      b) the\u00a0substitute meets\u00a0all the conditions for the fruition of the service\u00a0(by Article\u00a010\u00a0LegislativeDecree\u00a0111\/95)\u00a0and\u00a0in particular\u00a0the requirements for\u00a0passport,\u00a0visas,\u00a0health certificates;<\/p>\n

      c) the\u00a0incoming subject reimburses all expenses incurred by the organizer\u00a0to proceed\u00a0 with the substitution to the extent\u00a0that such expenses will be quantified\u00a0before the transfer.<\/p>\n

      The transferor and the\u00a0transferee\u00a0are also jointly and severally liable\u00a0for the payment\u00a0of the balance due\u00a0and the amounts\u00a0referred to in subparagraph\u00a0c) of this\u00a0article.<\/p>\n

      In relation\u00a0to certain types of\u00a0services, it can happen that a third\u00a0service provider\u00a0does not accept the\u00a0change\u00a0of the name\u00a0of the transferee,\u00a0even if\u00a0within the period\u00a0referred to in\u00a0point a) above.\u00a0The organizer\u00a0shall not be in such case liable\u00a0for any\u00a0rejection\u00a0of the amendment by the\u00a0third party service providers.<\/p>\n

      Any such rejection will be immediately communicated by the organizer\u00a0 to interested parties\u00a0prior to departure.<\/p>\n

       <\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/form>\n<\/div>\n<\/div>\n

       <\/p>\n

      \u00a011)\u00a0OBLIGATIONS\u00a0OF PARTICIPANTS<\/strong><\/p>\n

      Participants\u00a0are required to have individual passports\u00a0or other valid document\u00a0for all\u00a0countries to be visited in the itinerary,\u00a0as well as\u00a0tourist and transit\u00a0visas\u00a0and health certificates\u00a0if required.\u00a0They\u00a0must also respect\u00a0the\u00a0rules of normal prudence\u00a0and diligence as well as those specifications\u00a0in force\u00a0in countries\u00a0of destination,\u00a0all\u00a0information provided them by the organizer, and regulations and administrative provisions\u00a0relating to the tour package.\u00a0Participants\u00a0will be liable for all damages\u00a0that the\u00a0organizer may suffer because of their\u00a0failure to fulfill the\u00a0above obligations.<\/p>\n

       <\/p>\n

      The consumer is bound to\u00a0 provide the organizer with all\u00a0documents, information\u00a0and\u00a0evidence in its possession\u00a0relevant to the exercise\u00a0of the organizer’s right of subrogation\u00a0against third parties responsible for damage, and is liable to\u00a0the organizer\u00a0of the injury\u00a0caused to the right\u00a0of subrogation.\u00a0 The consumer\u00a0must also inform the\u00a0organizer in writing, at the time\u00a0of booking, about any special personal requests\u00a0that may be the subject of specific agreements as to the travel arrangements, provided that they\u00a0are possible to implement.<\/p>\n

       <\/p>\n

      12)\u00a0HOTEL\u00a0CLASSIFICATION<\/strong><\/p>\n

      The official classification of\u00a0hotel facilities is provided in the\u00a0catalog or other\u00a0information material only in accordance with\u00a0the explicit and formal indications of the competent\u00a0authorities\u00a0of the country where\u00a0the service is provided.\u00a0In the absence of official classifications\u00a0recognized\u00a0by the competent Public Authorities\u00a0of the countries also members\u00a0of the\u00a0EU\u00a0where the\u00a0service is provided,\u00a0the organizer\u00a0reserves\u00a0the right to provide by\u00a0 catalog\u00a0or brochures, the organizer’s own description\u00a0of the accommodation,\u00a0such as to allow an evaluation and\u00a0subsequent acceptance\u00a0of the same\u00a0by the consumer.<\/p>\n

       <\/p>\n

      13)\u00a0SYSTEM OF\u00a0LIABILITY<\/strong><\/p>\n

      The organizer\u00a0is liable for damages\u00a0caused to consumers\u00a0due to total\u00a0or partial non-fulfillment of\u00a0the due contractual services,\u00a0whether\u00a0these are performed by the organizer personally\u00a0or by third party\u00a0service providers,\u00a0unless the organizer proves\u00a0that the event arised by\u00a0the consumer (including initiatives autonomously undertaken by the latter\u00a0during the execution of\u00a0tour services)\u00a0or by\u00a0circumstances beyond\u00a0the provision\u00a0of services under the contract,\u00a0by accident, force majeure,\u00a0or circumstances\u00a0which the organizers\u00a0could not, according to the\u00a0professional diligence, reasonably foresee\u00a0or solve.<\/p>\n

      The seller from\u00a0whom \u200b\u200bthe booking of the tour package is made,\u00a0 do not\u00a0assumes any liability\u00a0for the obligations arising\u00a0from organizing the travel , but\u00a0is only liable\u00a0for the obligations arising\u00a0from his\u00a0role as intermediary, and only within the the extent\u00a0provided\u00a0by the\u00a0 laws or\u00a0conventions mentioned above for such\u00a0 liability.<\/p>\n

       <\/p>\n

      \u00a014)\u00a0LIMITATION\u00a0OF DAMAGES<\/strong><\/p>\n

      \n
      \n
      The\u00a0compensation owed\u00a0by the organizer\u00a0for personal injury\u00a0can not in\u00a0any case\u00a0be higher than indemnity for damages\u00a0provided for\u00a0by international agreements\u00a0with respect\u00a0to services whose non-fulfillment has determined the responsibility:\u00a0namely,\u00a0 the\u00a0Warsaw Convention of 1929\u00a0on international air transportation\u00a0in its version amended\u00a0at The Hague\u00a0in 1955; the\u00a0Berne Convention\u00a0(CIV) on rail transportation; the\u00a0Brussels Convention\u00a0of 1970 (CCV)\u00a0on the travel contract\u00a0for any supposition of liability\u00a0of the organizer.\u00a0In any case, the compensation limit may not exceed\u00a0the amount of\u00a0 “2,000\u00a0gold Germinal Francs\u00a0 for\u00a0damage to property” provided for by\u00a0 Article 13\u00a0No. 2\u00a0CCV and\u00a05000\u00a0gold Germinal Francs\u00a0 for any other damage\u00a0and for\u00a0those set by\u00a01783\u00a0Civil Code.<\/div>\n<\/div>\n
      \n
      \n
      15)\u00a0SERVICE\u00a0OBLIGATION<\/strong><\/div>\n<\/div>\n
      The\u00a0organizer is obliged to\u00a0lend such assistance measures to the\u00a0consumer as are imposed by the criterion\u00a0of professional diligence, solely in respect of obligations\u00a0 for which the organizer is responsible as required by law or\u00a0contract.<\/div>\n
      The organizer and the\u00a0seller are exempt\u00a0from their respective responsibilities\u00a0(Articles 13\u00a0and 14), in those cases where failure\u00a0or\u00a0improper performance of the contract is\u00a0attributable to the consumer\u00a0or derives\u00a0from an unforeseeable or\u00a0unavoidable circumstance from a third party, or\u00a0by a fortuitous circumstance or force majeure.<\/div>\n<\/div>\n<\/div>\n

       <\/p>\n

      16)\u00a0CLAIMS AND COMPLAINTS<\/strong><\/p>\n

      The customer\u00a0in accordance with Article\u00a019 No\u00a02 of Legislative Decree\u00a0111\/95\u00a0must notify the organizer\u00a0in the form\u00a0of a complaint\u00a0the irregularities\u00a0and vices\u00a0of the tour package,\u00a0as well as\u00a0the failures\u00a0in its organization or realization immediately as they\u00a0 have occurred so that the organizer\u00a0can promptly remedy.\u00a0If\u00a0not immediately\u00a0possible, the customer\u00a0can\u00a0also\u00a0lodge a\u00a0complaint by sending\u00a0a\u00a0 letter, by certified mail with return receipt, to the organizer or the seller, not later\u00a0than 10 working days\u00a0from the date\u00a0of\u00a0return to the place\u00a0of departure.<\/p>\n

       <\/p>\n

      17)\u00a0INSURANCE\u00a0AGAINST CANCELLATION\u00a0AND RETURN<\/strong><\/p>\n

      Nyala\u00a0Wonder\u00a0Travel is covered by\u00a0insurance policy no\u00a070435044.00\u00a0with\u00a0SAI\u00a0S.p.A.\u00a0for civil liability\u00a0under Articles.\u00a015 and 16 of Legislative Decree\u00a0111\/95.\u00a0If\u00a0not expressly included\u00a0in the price, it is\u00a0possible, indeed advisable, to stipulate, at the time\u00a0of booking at the offices\u00a0of the organizer\u00a0or seller, or directly with\u00a0specialized insurance companies,\u00a0 a special insurance policy\u00a0against the costs\u00a0arising\u00a0from cancellation of the\u00a0package, accidents\u00a0and luggage.\u00a0It will also be\u00a0possible to conclude an assistance contract\u00a0that covers\u00a0repatriation costs in case\u00a0of accident or illness.<\/p>\n

      18)\u00a0GUARANTEE FUND<\/strong><\/p>\n

      The National Guarantee\u00a0Fund is established\u00a0at the Directorate\u00a0General\u00a0for Tourism\u00a0of the Ministry\u00a0of Productive Activities, to which the consumer may refer\u00a0 (Article 21\u00a0Legislative\u00a0Decree 111\/95),\u00a0in the event\u00a0of insolvency\u00a0or bankruptcy\u00a0of the seller or\u00a0said\u00a0organizer, for the\u00a0protection of the following needs:<\/p>\n

      a) refund of the price paid;<\/p>\n

      b) repatriation in\u00a0case of foreign travel.<\/p>\n

       <\/p>\n

      The\u00a0fund must also\u00a0provide immediately available funds\u00a0in case of\u00a0forced return\u00a0of tourists from\u00a0non-EU countries on occasion of emergencies either due or not\u00a0 to the behavior of the organizer.<\/p>\n

      The assistance procedures of\u00a0the Fund are\u00a0established by decree of\u00a0President\u00a0of the Council\u00a0of Ministers of 23\/07\/99,\u00a0No\u00a0349\u00a0G.U.\u00a0no.249\u00a0of12\/10\/1999 (Article 21\u00a0Legislative Decree\u00a0No. 5\u00a0n.111\/95).<\/p>\n

      \u00a0A)\u00a0REGULATORY PROVISIONS<\/strong><\/p>\n

      Contracts covering the supply\u00a0of\u00a0 only\u00a0transport services,\u00a0accommodation or\u00a0any other separate\u00a0tourist service,\u00a0not being able to be construed as a\u00a0 case in point\u00a0of contractual organization\u00a0of a trip or\u00a0travel package,\u00a0are governed\u00a0by the following provisions\u00a0of the CCV:\u00a0Article\u00a01\u00a0,\u00a0# 3 and\u00a0# 6, Arts.\u00a017 to\u00a023, Arts.\u00a024 to\u00a031, with\u00a0regard to provisions\u00a0other than those relating\u00a0to organization contract and to other agreements specifically\u00a0referred to the\u00a0sale of a single service under\u00a0contract.<\/p>\n

      \u00a0B) CONDITIONS\u00a0OF CONTRACT<\/strong><\/p>\n

      These\u00a0contracts are moreover subject to the following\u00a0clauses\u00a0of the above general conditions of sale contract of tour packages:\u00a0Article4 1\u00a0first paragraph; Article\u00a05; Article\u00a07;Article 8; Article 9; Article\u00a010 1\u00a0first paragraph; Article\u00a011, Article\u00a015;\u00a0Article\u00a017.<\/p>\n

      The application of\u00a0the aforementioned clauses does not at all determine the configuration\u00a0of the related contracts\u00a0as a case\u00a0of a tourist package.\u00a0The\u00a0terminology\u00a0 of those clauses relating to the\u00a0contract of tour package (tour organizer, etc..) is therefore to be understood with reference\u00a0to the corresponding figures\u00a0of the\u00a0sales contract for single tourist services (seller, accommodation,\u00a0etc.).<\/strong><\/p>\n
